1. Agreement to Terms

Welcome to The Digitizer (the “Site”), an online news and technology information service provided by The Digitizer. These Terms of Use (“Terms”) govern your access to and use of the Site, including any content, functionality, and services offered on or through https://thedigitizer.net/.

By accessing or using the Site, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at https://thedigitizer.net/privacy-policy, incorporated herein by reference. Our Privacy Policy provides details on how we collect, use, and protect your personal data in compliance with applicable data protection laws, including the Brazilian General Data Protection Law (LGPD – Lei Geral de Proteção de Dados Pessoais). We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. 4. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by The Digitizer, its licensors, or other providers of such material and are protected by Brazilian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.
You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
If we provide social media features with certain content, you may take such actions as are enabled by such features.

You must not:

5. Trademarks

The Digitizer name, the Ther Digitizer logo, and all related names, logos, product and service names, designs, and slogans are trademarks of The Digitizer or its affiliates or licensors. You must not use such marks without the prior written permission of The Digitizer. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

6. Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

In any way that violates any applicable Brazilian federal, state, local, or international law or regulation (including, without limitation, the Marco Civil da Internet and LGPD).
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards set out in these Terms.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate The Digitizer, a The Digitizer employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm The Digitizer or users of the Site, or expose them to liability.

Additionally, you agree not to:

Use the Site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Site.
Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
Otherwise attempt to interfere with the proper working of the Site.

7. User Contributions (e.g., Comments)

The Site may contain message boards, forums, comment sections, and other interactive features (collectively, “Interactive Services”) that allow users to post content or materials (collectively, “User Contributions”) on or through the Site. All User Contributions must comply with the Content Standards set out in these Terms.

By providing any User Contribution on the Site, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose, in accordance with applicable law.

You represent and warrant that:

You own or control all rights in and to the User Contributions and have the right to grant the license granted above.
All of your User Contributions do and will comply with these Terms and applicable Brazilian law.

You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not The Digitizer, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness. We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Site.

8. Monitoring and Enforcement; Termination

We have the right to:

Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
Take any action with respect to any User Contribution that we deem necessary or appropriate.
Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, or as required by law or a court order in Brazil.
Take appropriate legal action for any illegal or unauthorized use of the Site.
Terminate or suspend your access to all or part of the Site for any or no reason, including any violation of these Terms.

YOU WAIVE AND HOLD HARMLESS THE DIGITIZER AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING, OR AS A CONSEQUENCE OF, INVESTIGATIONS BY EITHER SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES IN ACCORDANCE WITH BRAZILIAN LAW.

9. Content Standards

These content standards apply to any and all User Contributions. User Contributions must comply with all applicable Brazilian laws and regulations. User Contributions must not:

Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable under Brazilian law.
Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other ground prohibited by Brazilian law.
Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under Brazilian law or that otherwise may be in conflict with these Terms and our Privacy Policy.
Be likely to deceive any person.
Promote any illegal activity.
Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.

10. Copyright Infringement

We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with applicable Brazilian Copyright Law (Lei de Direitos Autorais – Law No. 9.610/98).

If you believe that any User Contribution or other material on the Site infringes your copyright, please provide us with a written notification that includes the following information:

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of applicable Brazilian law, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We reserve the right to remove User Contributions alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, we will also terminate a user’s account if the user is determined to be a repeat infringer.

11. Reliance on Information Posted

The information presented on or through the Site is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Site, or by anyone who may be informed of any of its contents, to the fullest extent permitted by Brazilian law.

12. Links from the Site

If the Site contains links to other sites and resources provided by third parties (including affiliate links), these links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to this Site, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

13. Disclaimer of Warranties

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. NEITHER THE DIGITIZER NOR ANY PERSON ASSOCIATED WITH THE DIGITIZER MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

TO THE FULLEST EXTENT PROVIDED BY BRAZILIAN LAW, THE DIGITIZER HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE BRAZILIAN LAW, SUCH AS THOSE PROVIDED UNDER THE BRAZILIAN CONSUMER DEFENSE CODE (CÓDIGO DE DEFESA DO CONSUMIDOR – LAW NO. 8.078/90), IF APPLICABLE.

14. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY BRAZILIAN LAW, IN NO EVENT WILL THE DIGITIZER, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY BRAZILIAN LAW (E.G., IN CASES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR AS STIPULATED BY THE BRAZILIAN CONSUMER DEFENSE CODE, IF APPLICABLE).

15. Indemnification

You agree to defend, indemnify, and hold harmless The Digitizer, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

16. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the competent courts located in São Paulo, SP, Brazil. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

17. Waiver and Severability

No waiver by The Digitizer of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

18. Entire Agreement

The Terms of Use and our Privacy Policy (and Cookie Policy, if linked and incorporated) constitute the sole and entire agreement between you and The Digitizer regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
